1. Acceptance of Terms

By accessing or using Toggle AI (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Toggle AI ("we," "our," or "us").

2. Description of Service

Toggle AI is a multi-LLM aggregation platform that allows users to send a single prompt to multiple AI models simultaneously and compare their responses side by side. The Service provides access to various third-party AI models through a unified interface. We do not create or control the AI models themselves; we act as an intermediary that routes your requests to these providers.

3. Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Payments

4.1 Free Plan

The Service offers a free tier with limited access to AI models and a restricted number of monthly queries. Free plan features may change at any time without notice.

4.2 Paid Plans

Paid subscription plans (Pro, Max, Enterprise) provide additional features, higher query limits, and access to more AI models. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis (monthly or annually) until you cancel.

4.3 Free Trials

We may offer free trial periods for paid plans. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

4.4 Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. Refunds are generally not provided for partial billing periods, except as required by applicable law.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Violate any applicable laws, regulations, or third-party rights
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated means (bots, scrapers, etc.) to access the Service without our express permission
• Circumvent usage limits, rate limits, or other technical restrictions
• Resell, redistribute, or sublicense access to the Service without authorization
• Use the Service to develop competing products or services

6. Intellectual Property

6.1 Our Property

The Service, including its design, features, code, and branding, is owned by Toggle AI and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

6.2 Your Content

You retain ownership of the prompts you submit and any original content you create using the Service. By using the Service, you grant us a limited license to process your prompts for the purpose of providing the Service. We do not claim ownership of your input or the AI-generated responses.

6.3 AI-Generated Content

Responses generated by AI models through the Service are produced by third-party AI providers. The ownership and usage rights of AI-generated content may be subject to the terms of the respective AI providers. We make no claims of ownership over AI-generated responses.

7. Third-Party AI Models

The Service integrates with multiple third-party AI model providers (including but not limited to OpenAI, Anthropic, Google, xAI, Mistral, and others). Your use of these models through our Service is also subject to the respective providers' terms of service and acceptable use policies. We are not responsible for the accuracy, completeness, or appropriateness of responses generated by these third-party models.

8. BYOK (Bring Your Own Key)

The Service may allow you to use your own API keys for certain AI providers. When using BYOK, you are responsible for any charges incurred with those providers. We encrypt and securely store your API keys but are not liable for any unauthorized use resulting from a security breach beyond our reasonable control.

9. Shared Content

The Service allows you to share AI comparison results via public links. When you share content, it becomes publicly accessible to anyone with the link. You are responsible for ensuring that shared content does not contain sensitive, confidential, or inappropriate information. You may delete shared content at any time.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED RESPONSES MAY CONTAIN INACCURACIES, BIASES, OR ERRORS. YOU SHOULD NOT RELY ON AI-GENERATED CONTENT FOR CRITICAL DECISIONS WITHOUT INDEPENDENT VERIFICATION.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOGGLE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Toggle AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the modified Terms.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Toggle AI operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
